FORT COLLINS, Colo.—Attorneys for a Fort Collins police officer accused of lying in a murder case want a judge to throw out the perjury case against him, saying prosecutors withheld evidence from a grand jury that indicted him.
The Coloradoan reports that attorneys for police Lt. Jim Broderick say in new court filings that perjury charges against their client are either unsupported by the evidence or based on statements that are incomplete or out of context.
A grand jury indicted Broderick in June on eight counts of first-degree perjury in the investigation of Timothy Masters. Broderick is on paid leave from the police department.
Masters served nearly a decade in prison in the stabbing death of a Fort Collins woman before his conviction was overturned by DNA evidence.
