
CASTLE ROCK — A judge today agreed to stay the release of the arrest affidavit in the sexual assault case against Denver Broncos cornerback Perrish Cox.
The stay is in effect until the Colorado Supreme Court decides whether to review the appeal of the release, or, if the top court does decide to review it, until a ruling is made.
The earliest the court would issue a ruling is July 14.
The affidavit outlines the evidence prosecutors have against Cox.
Cox, 24, has been charged with two felonies: sexual assault on a helpless victim, and sexual assault on a victim incapable of appraising her condition. If convicted, he faces a minimum of two years in prison and a maximum of life. His trial is scheduled for October.
On Oct. 28, a woman reported the alleged assault that she said occurred Sept. 6. Cox was arrested Dec. 9 and pleaded not guilty in May. He is free on bail.
“Unfortunately, there is not a set timetable,” said attorney Steve Zansberg, who is representing The Denver Post and the Associated Press in arguing for the release of the affidavit. “It could be weeks or months.”
The defense, the prosecution and the attorney for the alleged victim have all argued for the affidavit to remain sealed.
Douglas County District Court Judge Paul King issued the ruling.
A redacted affidavit was to be released on Friday.
