A Lafayette man whose roommate was found dead last year under suspicious circumstances has been indicted by a Boulder County grand jury on charges of concealing a death, tampering with evidence and attempting to influence a public servant.
Enrique Jose Garcia, 41, was arrested last year on similar charges after investigators said he took the gun that killed his roommate, Kelly Lee Willard, 24, and fled the state — but prosecutors later dropped the charges.
The grand jury indictment was signed Aug. 12 and sealed by a judge. Garcia was arrested in Arapahoe County last week and transferred to the Boulder County Jail on Friday.
The indictment, which has been unsealed, did not show significant new evidence in the case.
“We only take cases to the grand jury that we believe are important,” said Boulder County District Attorney Stan Garnett. “We respect the hard work of the Lafayette Police Department. We wanted to feel that we had done everything we could to develop the evidence and carefully consider what charges would be appropriate.”
