The homeless man who police say stabbed two other men — one of them fatally — told officers he was trying to defend himself after the two men attacked him.

Charles Edward Waters, 56 — who was arrested by police on suspicion of first degree murder and attempted first degree murder — told police that he was sleeping in an abandoned shed when he was attacked by two men, according to a police report. He told police that the two men tried to “choke him out,” and he used a knife to defend himself.

Both victims were transported to the Boulder Community Hospital. One of the men later died in surgery, while the other — identified in the report as Michael Giampino, 28 — is recovering.

Giampino declined to comment when reached at the hospital. The Boulder County Coroner’s Office has not yet identified the other victim, but the report said his name may have been Johnny.
