FORT COLLINS — Attorneys for Fort Collins police Lt. Jim Broderick argued Tuesday that five counts of a nine-count indictment accusing him of felony perjury should be dismissed.

Lawyers Patrick Tooley and Thom as Dunn attacked the five counts, saying they failed to show Broderick knowingly lied in his investigation into the 1987 death of Peggy Het trick.

Tim Masters was convicted in 1999 of killing Hettrick, with Broderick working as the lead investigator in the case. Masters was released from prison in 2008 after new DNA evidence pointed to someone else.

The indictment claims Broderick lied in documents and in testimony he gave against Masters in the 1999 trial.

Prosecutors on Tuesday argued that the language in the indictments clearly showed Broderick committed perjury.

Boulder County District Judge Ingrid Bakke indicated Tuesday afternoon she would issue a ruling on the indictments in the coming weeks.

Broderick is on paid administrative leave from the city of Fort Collins.
