The Direct Marketing Association has been granted a 15-day extension to appeal a ruling that effectively reinstates Colorado’s so-called Amazon tax law.
The group, which represents about 2,000 member businesses, now has until Sept. 18 to file a petition for rehearing from the full Tenth Circuit Court of Appeals.
Last week, the that a lower court overstepped its jurisdiction when it threw out the law, which is designed to urge large Internet retailers to collect from Colorado residents a 2.9 percent use tax on purchases. The ruling ordered the district court to reverse its decision to bar Colorado from enforcing the law.
The previous deadline for the DMA to seek an “en banc” review was Sept. 3. The group has argued that the Amazon law is unconstitutional. The motion for an extension, which was unopposed, was granted Monday.
