PUEBLO, Colo.—A judge has rejected a request for a hearing on how The Pueblo Chieftain obtained a sealed document in the case of Harry Carl Mapps, who is accused of killing three people and setting fire to their home.
KRDO-TV reports ( ) the judge told defense attorney David Lipka Tuesday he could investigate on his own how the newspaper obtained the arrest warrant affidavit for the 59-year-old Mapps.
Mapps faces charges of first-degree murder and arson. He is accused of fatally shooting 55-year-old Kim Tuttle, her 51-year-old husband, Reggie, and their 33-year-old daughter, Dawn Roderick.
Their bodies were found in the Tuttles’ home in Rye after it was damaged by fire on Nov. 27.
Mapps was arrested a month later in Oklahoma.
His next court appearance is scheduled for Feb. 18.
