The Denver District Attorney has declined to file charges against a city employee arrested on suspicion of attempted murder.

Damion Baca, 33, was released from jail Wednesday, said Lynn Kimbrough, spokeswoman for the district attorney’s office.

“After review, we believe there was no reasonable likelihood of conviction,” she said.

Police continue to investigate the case of a drive-by shooting that occurred in December, Kimbrough said.

Baca was put on administrative leave after he was arrested.

Calls to Denver Parks and Recreation for comment were not immediately returned.
