Dish Network and chairman Charlie Ergen want a judge to throw out a racketeering lawsuit brought by Philip Falcone’s Harbinger Capital Partners hedge fund firm, saying Harbinger is “desperate” to find someone to blame for its $2 billion loss in LightSquared, Falcone’s wireless venture.
In a Thursday filing with U.S. District Court in Denver, lawyers for Douglas County-based Dish and Ergen said Harbinger’s $1.5 billion suit is another attempt to “shift blame” for losses by Harbinger and its investors in LightSquared.
“It has no one to blame but itself,” lawyers for Dish and Ergen said in the filing.
