
An Eagle County sheriff’s deputy accused of sexually assaulting a woman allegedly drove her to vacant commercial space and slammed her head into the ground before the attack, court records show.
“I killed her,” the victim said she overheard the deputy say after the alleged assault.
Timothy Joseph Hay, an 11-year veteran of the sheriff’s office, is accused of assaulting an “acquaintance” on Sept. 18 while off duty. He was arrested Friday, the 5th Judicial District Attorney’s Office said in a news release.
The victim told investigators she was having drinks with Hay and other friends at the Eagle Bowling Alley before the assault.
Police say a sexual assault exam showed the victim had suffered trauma, records show. Investigators found suspected blood in the commercial space, described as a warehouse, where the assault allegedly occurred.
The woman said she knew Hay for roughly two years before the assault, during which they had an ongoing romantic relationship, records say.
Hay was taken into custody without incident at his home in Gypsum and formally advised in court. A judge set Hay’s bail at $15,000.
Hay is next due in court on Oct. 22.
