BOULDER — The Boulder detective accused of tipping off a suspect who was being investigated for Internet sexual exploitation of a child has resigned from the department.

Detective Jack Gardner, 56, submitted his resignation on Wednesday, according to Boulder police spokeswoman Kim Kobel. Gardner had been on unpaid administrative leave pending an internal personnel investigation, which is still ongoing.

Gardner on Wednesday was charged with being an accessory to a crime — a Class 5 felony — and misdemeanor counts of first-degree official misconduct and obstructing a peace officer.

According to the Jefferson County district attorney’s office, which has been appointed as a special prosecutor in the case, Boulder police were investigating Kahlil Hill Peckham, 26, in May when he sent more than 700 texts and sexually graphic exchanges to an undercover police officer posing as a 13-year-old girl. But investigators say Gardner warned Peckham not to go to a meeting that Boulder police had arranged.
