Federal suit filed against former El Paso County sheriff Terry Maketa seeks damages

COLORADO SPRINGS — A federal lawsuit filed Monday claims former El Paso County Undersheriff Paula Presley kept a “missing” internal affairs file on the current sheriff at her house during a highly publicized controversy.

The suit seeks damages for “evil” and “outrageous” behavior on behalf of Presley and former Sheriff Terry Maketa, naming them in their official and individual capacities.

The El Paso County Commission also is being sued because of Maketa and Presley’s former employment with the county, which means it would be liable for any damages won against them in their official capacities.

The complaint was filed by El Paso County Sheriff’s Office employees Chief Mitch Lincoln, Cmdr. Rodney Gehrett, Cmdr. Rob King, Lt. Cheryl Peck and Sgt. Rob Stone.
