BOULDER, Colo. (AP) — The driver accused in a crash that killed a Colorado State Patrol cadet and critically injured a trooper is due to make his first court appearance.

Twenty-seven-year-old Christopher Gebers is scheduled to be advised of the charges he’s facing during a hearing Wednesday morning in Boulder.

Authorities say he was fleeing a traffic stop Saturday in Weld County when he plowed into the scene of a separate accident investigation being conducted by state troopers. He hit cadet Taylor Thyfault and Trooper Clinton Rushing, who had been putting out stop sticks to try to top Gebers.

According to his arrest affidavit, Gebers claimed the crash wasn’t his fault because the emergency brake on his Honda Civic locked up and the accelerator was stuck.
