The National Federation of Independent Business on Friday said it will appeal a Nov. 3 Colorado’s Secretary of State Wayne Williams may continue to use business filing fees to cover the cost of regulating elections and other activities of his office.
In its , NFIB said the lower court erred by failing to rule whether the $20 million in fees collected each year are taxes and in its conclusion that the charges are not subject to TABOR, the state’s tax limitation measure.
NFIB, the largest small-business association in the suit, are an “illegal tax on businesses to fund obligations that should be a cost shared by everyone.”
The secretary of state receives no money from Colorado’s general fund and so relies on the business filing fees to cover its costs. NFIB wanted the business filing fees set to an amount that reflects their specific regulatory costs.
