A sex assault charge against a defendant has been dropped by prosecutors so as not to jeopardize an intertwined missing persons case.
Jeffrey Beier, 42, faced a felony sex assault charge in Arapahoe District Court, but the District Attorney’s Office filed on Thursday a motion to dismiss the charge.
An investigation into the , Beier’s girlfriend, by the the Littleton Police Department is ongoing.
Voightap family reported her missing July 8 after they hadn’t heard from her for more than a week.
Littleton police arrested Beier for suspicion of sex assault on July 12. Voight was not the victim in the sex assault case.
In the motion to dismiss the sex assault charge, prosecutors said: “Due to the nature of this case, it has become factually intertwined with an ongoing missing person investigation. As such, the District Attorney is in the unusual position of having to provide discovery relating to an ongoing investigation to defense counsel in this case.
“Regardless of who may be involved in the missing person case, law enforcement must be able to conduct an investigation without disclosing information relating to an active investigation to non-law enforcement personnel.”
The DA’s office, in the motion to dismiss, said it has talked to the victim in the sex assault and “she does not object to the dismissal at this time.”
