Sen. Cory Gardner is correct that recent appropriation acts prohibit the use of funds to transfer detainees from Guantanamo Bay to the United States, and therefore the administration has broken the law by funding a study on transferring people to Colorado prisons. But how do we balance that with the Constitution’s prohibition against imprisoning someone without due process?
Mark Matthews’ article states that “now only a few dozen [detainees] remain at Guantanamo Bay.” More specifically, there are 61 people being held prisoner, 20 of whom are cleared for release. To reiterate: We are imprisoning 20 people without even the pretense of a legal reason to do so.
I appreciate Gardner’s attention to enforcing the letter of the law. But the law also requires liberty for people who have been wrongly imprisoned, and a fair trial for those who can be charged.
