A 20-year-old man who allegedly fled the scene of a two-car crash in which an Uber driver was injured and his passenger killed, appeared to be intoxicated shortly afterward, according to the Denver District Attorney’s Office.

Prosecutors charged with vehicular homicide, driving under the influence, and other violations Wednesday.

Valdez-Refugio allegedly fled the scene of the crash early Sunday at East 14th Avenue and Franklin Street in Denver on foot, and was arrested at a different location.

The defendant allegedly exhibited indications of “impairment,” according to a District Attorney’s Office news statement released Thursday. “Subsequent investigation determined the defendant to be at-fault,” the statement said.

The victim has not been identified.

Following the crash Denver police said they had one person in custody, but didn’t immediately identify the suspect.

Valdez-Refugio is scheduled to appear for his second advisement Friday at 8 a.m.
