Boulder to pay $19K to driver whose car was damaged by city snowplow

The city attorney recommended paying the settlement because going to trial could cost the city more

The Boulder City Council voted unanimously Tuesday night to settle, for $19,343.27, a lawsuit brought by a man whose car was damaged in a crash with a city snowplow.

The man, Martin Jacobs, was involved in a crash on Dec. 23, 2017, at the intersection of 63rd Street and Arapahoe Avenue with Peter Hinostroza, who was driving the city plow, according to the settlement agreement.

City Attorney Tom Carr advised the council members prior to their vote that it is impossible to predict the outcome of a trial and that, “Given the projected costs of litigation … it is unlikely that the city will be in a significantly better economic position by litigating the case as compared to accepting the settlement offer.”
