GREELEY, Colo.—A judge has dismissed a charge of attempted first-degree assault against a former Weld County deputy district attorney accused of threatening to kill his former boss.

Daniel Wingler, 29, still faces charges of menacing and a bond violation, plus a separate charge of cultivating marijuana.

Wingler was free on bond on the marijuana charge when prosecutors say he left a phone message Nov. 8 for his former supervisor at the Weld District Attorney’s Office, which was prosecuting him on the marijuana charge. He was arrested in Texas, which prosecutors said was a bond violation.

On Thursday, Weld District Judge Gilbert Gutierrez said there was not enough evidence to move forward with the charge of attempted first-degree assault, but the other charges could proceed.

Boulder County Assistant District Attorney Pete Maguire was handling the threat case as a special prosecutor.
