TELLURIDE, Colo.—The owner of land outside Telluride that the town condemned to preserve open space is appealing to the State Supreme Court.

A district judge already approved the condemnation and required the town to raise $50 million to pay for the land.

Land owner Neal Blue has appealed the district court decision to the Colorado Supreme Court.

Tom Ragonetti, the lawyer representing Blue, declined comment.

Attorneys say Blue contends that a bill passed by the Colorado Legislature in 2004 precludes a town condemning land outside its boundaries for open space.

The town disagrees.
