DENVER—A Louisville mother whose 10-week-old son died after being taken to a hospital with 30 broken bones is seeking a new trial, because she says she was afraid of her husband and his family.
An appeal was filed Monday in Boulder on behalf of 29-year-old Molly Midyette. A jury convicted Midyette in December on a charge of child abuse resulting in death.
She is awaiting sentencing, and could face up to 48 years in prison.
Midyette’s appeal alleges that her husband, Alex, and his family intimidated her, and that the grand jury that indicted her was also tampered with by her husband and his relatives.
Alex Midyette is scheduled to stand trial May 27th on charges that he injured the couple’s son, Jason.
The boy died in March 2006.
