BOULDER, Colo.—Prosecutors agree with lawyers for a man seeking to move his child abuse trial out of Boulder on grounds that it will be difficult to find an impartial jury here.

Alex Midyette is charged with fatal child abuse in the death of his infant son, Jason, in 2006. His attorneys want to move the trial on grounds that extensive media coverage of the case could hurt Midyette’s chances for a fair trial in Boulder.

In a response filed Friday in Boulder District Court, Chief Deputy District Attorney Ken Kupfner agreed. He wrote that Midyette could still receive a fair trial in the metro-Denver area though.

He said Saturday that his primary concern is to prevent any more delays in Midyette’s trial, originally scheduled for January but now set for Oct. 6.

Kupfner cited Adams, Broomfield and Jefferson counties as the most convenient venues for the four-week trial.

A hearing has been scheduled for June 16 for a judge to determine whether to move the trial.

Midyette’s wife, Molly Midyette, has been sentenced to 16 years in prison for failing to seek medical treatment that might have saved the baby.
