Rick Dryer, founder of Mile High Capital, has six fewer felony counts to face. Prosecutors dismissed them after three witnesses declined to participate in his trial, which began with jury selection Monday.

Dryer still faces 61 fraud counts after his company collected about $44 million from 882 investors across the nation.

His company promised to invest clients’ money in duplexes, most of which were never built. The company then filed for bankruptcy. Dryer’s legal team says it was mismanagement, not fraud. Opening arguments in the trial are slated to begin at 8:30 a.m. today.
