ENGLEWOOD, Colo.—The Western Union Co. said Wednesday it is considering whether to appeal a court ruling on the authority of Arizona prosecutors to seize some money transfers to Mexico.
The Arizona Court of Appeals on Tuesday overturned a lower court ruling that prevented prosecutors from seizing certain transfers of suspected immigrant-smuggling money flowing from other U.S. states into northern Mexico.
Western Union, based in Englewood, said it was concerned by the ruling and was investigating opportunities to contest the decision, including an appeal.
In 2007, an Arizona judge had ruled that state prosecutors hadn’t shown they had jurisdiction to seize money from locations outside Arizona.
The appeals court said prosecutors had probable cause, the court had jurisdiction to issue the order, and the order didn’t violate constitutional protections on interstate commerce.
