BOULDER, Colo.—The trial of a Boulder man accused of fatal child abuse in the death of his 10-week-old son may be delayed past the scheduled Oct. 6 start.
Lawyers for 29-year-old Alex Midyette filed a motion Tuesday saying they might need more time to prepare because prosecutors have added several witnesses in the past few weeks and are still conducting medical tests.
Prosecutors say they added the witnesses because the defense indicated it will argue that Jason Midyette was not abused but had a rare metabolic condition.
The judge hasn’t ruled on the request.
Investigators say Jason had suffered more than two dozen broken bones when he died in March 2006.
His mother, Molly Midyette, was convicted of fatal child abuse in December and is serving a 16-year sentence.
