BOULDER, Colo.—The trial of a Louisville man charged in his 11-week-old son’s death is being pushed back from its scheduled Oct. 6 start to January.

District Judge Carol Glowinsky signed an order Friday to continue the trial of Alex Midyette, 29, until January. A hearing is set for Oct. 3 to pick a specific date.

Midyette is accused of fatal child abuse in the 2006 death of his son, Jason. Doctors say the infant had more than 20 broken bones and a skull fracture.

Defense lawyers filed a motion this week seeking more time because prosecutors recently added several witnesses. They said in a motion filed Friday that results from tests to determine if Jason had Menkes disease also need to be thoroughly reviewed before the trial.

Prosecutors have said they added medical witnesses because the defense has indicated it will argue that Jason wasn’t abused but suffered from the rare genetic disorder. Those witnesses include Dr. John Menkes, the disorder’s namesake, who are expected to rebut claims that Jason had the disease.

The boy’s mother, Molly Midyette, was convicted in December of fatal child abuse and is serving a 16-year sentence. Prosecutors said she waited too long to get medical care for her son, Jason, who died in March 2006.
