GOLDEN — A Lakewood man who claimed he shot and killed his roommate because he thought an intruder had broken into his home was sentenced Friday to 28 years in prison.

Floyd Nuss, 63, tried to use the “make my day” defense, referring to a law that allows residents to use deadly force to defend themselves in their homes.

He was convicted in August of second-degree murder and false reporting in the death of Richard Kohler, 51, in November 2006.

Nuss called 911 and reported that he had shot someone who had broken into his home in the 1300 block of South Wadsworth Boulevard.

Later, Nuss admitted that Kohler had been a tenant for four years and he had been trying to get him to move out.

During the trial, prosecutors presented evidence that Nuss was angry with Kohler because he was $700 behind in rent. A handwritten eviction notice that Nuss had put on the front door was found in Nuss’ pants pocket.
