GLENWOOD SPRINGS, Colo.—A woman whose home was flooded with 10 inches of sewage from a city sewer line may find her lawsuit tossed because she filed it late.

The West Glenwood Springs Sanitation District has asked a judge to reject a lawsuit from Donni Cochran, whose home was flooded with sewage in the summer of 2006. The sanitation district argues the lawsuit was filed after the two-year statute of limitations expired.

Cochran argues she filed her claim earlier but that the city didn’t respond. A Garfield County District Court judge will decide whether Cochran’s lawsuit may proceed.
