DENVER—The Colorado attorney general’s office says the state will receive more than $2.6 million as part of a settlement with Eli Lilly & Co. over allegations that the company illegally marketed the antipsychotic drug Zyprexa for off-label use.
The agreement represents Colorado’s share of a global settlement announced Thursday, in which the company will resolve four federal whistleblower lawsuits, as well as claims by numerous states and the federal government.
The settlement, totaling $1.42 billion, resolves allegations that Lilly promoted Zyprexa for uses not approved by the U.S. Food and Drug Administration.
Attorney General John Suthers called the agreement a “significant recovery for Colorado’s Medicaid program.” He says the case should send a message that Colorado won’t tolerate drug companies that fail to comply with the rules.
