The Colorado Board of Health on Monday postponed a critical hearing on medical marijuana scheduled for next month.
The board had been slated to re-examine its definition of a medical-marijuana “caregiver” at a hearing Dec. 16. That hearing was scheduled after a state Court of Appeals decision cast doubt on the constitutionality of the board’s earlier-adopted definition of a caregiver as someone who provides medical marijuana to patients.
Following that court’s October decision, the board repealed its definition at a meeting in which it took no public testimony. But that action received a sharp rebuke earlier this month from a Denver district judge.
A news release announcing the December hearing’s postponement said the board will receive legal advice before deciding when to reschedule.
