The father who said he accidentally wounded his 3-year-old son with a pistol was formally charged today with attempted first-degree murder, child abuse and menacing.
The Denver District Attorney’s office contends William Thalley, 29, shot his son during an argument with his wife on Nov. 22 in southwest Denver and tried to blame it on a driveby shooting.
His wife, Nicole Fernandez, 25, was charged being an accessory to the crime.
Thalley told investigators he pulled the pistol from a dresser in order to kill himself, but the gun went off unexpectedly and stuck his son in the leg, according to court documents.
The couple, however, initially told authorities a stranger shot at them at Morrison Road and Lowell Boulevard and hit the child.
Denver police investigated and found proof Thalley shot the boy in the family’s home, according to the District Attorney’s office.
The boy continues to recover and his parents remain in the Denver County Jail. Thalley is being held on a $275,000 bond. Fernandez bond was set $150,000.
