Jason Eric Kay, the Longmont artist accused of relabeling bottles of Gatorade with images of golfer Tiger Woods, his wife, Elin Nordegren, and the word “Unfaithful,” was released from federal custody Thursday.
Kay, 38, appeared in U.S. District Court in Denver, where he was charged with three product-tampering counts for allegedly relabeling Gatorade bottles and placing them on Front Range grocery shelves. If found guilty, he could serve up to to five years in prison.
In the arrest affidavit, Food and Drug Administration agent Daniel Burke said Kay told him he made the labels as “pop art” and did not realize he had done anything wrong.
