COLORADO SPRINGS, Colo.—A Colorado Springs man will go to trial for the death of his father, who prosecutors say was beaten and stuffed in a garbage can.
A judge ruled Friday that there’s enough evidence against 32-year-old Quinten Poncho Abeyta for a trial. Prosecutors say he used a claw or tile hammer to strike 55-year-old Russell Abeyta in the back of the head and then put his body in a trash can on Dec. 7.
A firefighter testified that when he went to Abeyta’s house, Abeyta told him he put his father in the trash can because he “didn’t want anyone else to have to.”
Abeyta told police he didn’t kill his father and his attorney says Abeyta’s friends and family have said he adored his father and would’ve done anything to protect him.
Quinten Abeyta is charged with second-degree murder and tampering with evidence.
