STEAMBOAT SPRINGS — A man on trial for a fight that left a Fort Bragg, N.C., soldier dead after a bar dispute appeared near tears as he testified that he was scared in the moments before the fight.

David Capote took the stand Friday in Steamboat Springs, where he is facing a third-degree assault charge for the fight that killed Sgt. 1st Class Richard Lopez. Capote’s brother, Eduardo Capote, is accused of punching Lopez. Police say the 37-year-old soldier died after falling and hitting his head on the pavement.
