CENTENNIAL, Colo.—An investigator says he was told there were two people in an SUV that crashed and killed three people, including a 3-year-old boy in an ice cream shop, bolstering claims by an illegal immigrant that he wasn’t the driver.
Aurora traffic investigator Johnny Lee testified that a report quoting a witness as saying there was only one person in the SUV is inaccurate.
A police officer who testified Thursday said the department is investigating Lee’s conduct.
Francis Hernandez faces vehicular homicide charges in the September 2008. His defense says that police focused on Hernandez and ignored the possibility that someone else may have been driving. Defense attorneys also pin some of the blame on the driver of a pickup truck who had methamphetamine in her system.
