There will be no traffic citations or criminal charges brought against the driver of a truck that struck and killed a 2-year-old boy on Sunday.

The accident happened Sunday in southwest Denver on the 400 block of South Clay Street.

Denver Police Department investigators presented the case to the Denver District Attorney’s Office. Prosecutors determined that no charges will be filed, said Lynn Kimbrough, a DA’s office spokeswoman.

“There was no evidence to support carelessness, no evidence of drugs or alcohol, no evidence of speeding,” Kimbrough said.

Edgar Bernal was pronounced dead at the scene and died of “multiple blunt force injuries,” according to the Denver Office of the Medical Examiner.

The child wandered away from a Mother’s Day gathering in a front yard and into the street, where he was struck and killed by a passing truck, police said.
