SALT LAKE CITY—A Denver court says a Utah inmate set for execution by firing squad on Friday has appealed a federal judge’s ruling against a stay.
Tenth U.S. Circuit Court of Appeals clerk Betsy Shumaker says a notice of appeal was filed on behalf of Ronnie Lee Gardner late Tuesday.
Shumaker says no request for a stay has been filed.
U.S. District Court Chief Judge Tena Campbell denied Gardner’s stay request during a Tuesday night hearing in Salt Lake City. The stay request is tied to a civil rights lawsuit Gardner filed to challenge Utah’s commutation hearing process.
Shumaker says attorneys on both sides have not filed any written arguments.
It’s unclear how quickly judges will address the case.
