
The Denver District Attorney’s Office has declined to file criminal charges against 62-year-old Filberto Alderete in connection with the shooting death of Jesus Sifuentes Jr. early Sunday.
The district attorney’s office said Alderete claimed he acted in self-defense, shooting Sifuentes as he forced his way into Alderete’s home.
Lynn Kimbrough, spokeswoman for Denver District Attorney Mitch Morrissey, said prosecutors could “not disprove, beyond a reasonable doubt,” Alderete’s self-defense claim.
Police responding to the scene found Sifuentes, 36, dead on the front porch of the Alderete home in the 3400 block of West 18th Avenue.
During the incident, Alderete’s grandson, Daniel Alderete, was wounded by police.
According to Denver police spokesman Sonny Jackson, police responded to the home about 12:34 a.m. Sunday after reports of disturbance and shooting in the vicinity.
As police attempted to reach Sifuentes, Jackson said they encountered Daniel Alderete holding a gun. Jackson said an officer fired a single shot at Daniel Alderete after he allegedly refused to put down the gun.
Alderete, 25, was taken to the Denver Health Medical Center where he was listed in fair condition.
Kimbrough said the the shooting that injured Daniel Alderete remains under investigation.
