DENVER—Third-party gubernatorial candidate Tom Tancredo will learn soon whether he’ll get to keep his spot on this fall’s ballot.

Denver District Court Judge William Hood says he’ll issue a ruling Tuesday in a lawsuit brought by two Republicans challenging Tancredo’s inclusion in the race.

The former Republican congressman is running as the American Constitution Party gubernatorial candidate. Tancredo told the judge Monday that his party’s bylaws trumped state law when he got his last-minute nomination in July.

The lawsuit claims Tancredo violated state law when he got the party’s nomination because he was not registered with the them for at least 12 months.
