Six months after taking the interim position as head of the Colorado Division of Real Estate, Marcia Waters has been named the agency’s director.
Waters replaces Erin Toll, who was placed on administrative leave in March before reaching a settlement with the state that resulted in her resignation.
Waters has served as the division’s director of investigations and compliance for 5 1/2 years. Before joining the division, Waters was a real-estate broker. She also has experience in law enforcement, rising to the rank of detective.
“Marcia has a clear vision of what she wants to accomplish as division director, is passionate about consumer protection and understands the dynamic nature of real estate in Colorado,” Barbara Kelley, executive director of the Department of Regulatory Agencies, which oversees the division, said in a statement. “She will continue to be open and approachable to the industry and will maintain her role as a stern and fair protector of the public’s interest.”
Toll was put on leave in March shortly after she told reporters that state Sen. Ted Harvey and the mortgage brokerage he works for were under investigation for allegedly breaking advertising rules. The announcement came after a verbal skirmish between Toll and Harvey during a legislative hearing.
DORA later said Harvey was not under investigation.
Toll claimed in a grievance to the State Personnel Board that Kelley, her boss, suspended her and targeted her for dismissal for whistle-blower activities.
Kelley denied the allegation.
Toll, who reached her settlement with the state in June, now works as a real-estate agent for Perry & Co.
