An armed man who attempted to rob a Denver marijuana dispensary faces 42 years in prison at his upcoming sentencing, according to the Denver District Attorney’s Office.
James Leyva, 22, has pleaded guilty to attempted aggravated robbery and illegal discharge of a firearm, both felonies, according to a media release from the DA’s office. He also pleaded guilty to two habitual criminal counts.
On Dec. 16, 2009, Leyva, armed with a gun, tried to rob the Healthy Choice medical-marijuana dispensary.
Leyva fired at a victim “but his gun jammed and other victims were able to disarm him and hold him until police arrived,” prosecutors said.
As part of a plea agreement Leyva, who remains jailed, will receive a 42-year term when he’s sentenced in Denver District Court on Feb. 7.
