A Texas grand jury could decide what charges, if any, should be filed against Colorado state Sen. Suzanne Williams, D-Aurora, stemming from a crash last month that killed a pregnant woman.

The Amarillo Globe-News reported Tuesday that Hartley County District Attorney David Green was “leaning toward taking the case straight to the grand jury” because of the publicity surrounding the Dec. 26 crash.

Williams has pushed for tougher seat-belt laws in Colorado, but none of the passengers in her Honda CR-V were buckled in when she swerved into the path of a GMC Yukon carrying 30-year-old Brianna Gomez of Amarillo and her family.

Texas requires seat belts on all vehicle occupants.

Gomez’s unborn son was delivered by cesarean section and remains hospitalized in critical condition, the Globe-News reported.

Investigators told the newspaper they were still trying to determine what caused Williams to veer into the path of the Yukon, driven by Brianna Gomez’s husband, Eric.

Williams’ attorney, David Lane, said blood taken from Williams after the crash would not show drugs or alcohol as a factor.

“In the absence of alcohol or drugs, charges should not be filed,” he told the Globe-News.

Lane said he “put the brakes on” Williams’ reaching out to the Gomez family.

“There will be a time and place for everything,” he said.

“I don’t want the Gomez family to think she’s tampering with them,” Lane said.
