Trial postponed in child’s death

Angel Ray Montoya ---- On September 21, 2007, Angel Ray Montoya, 1/18/1985, was arrested at E. 13th Ave. & Lincoln St. for investigation of Murder in the First Degree in relation to the suspicious disappearance of Niveah Gallegos, 8/1/2004. This investigation began as a reported kidnapping and quickly became a search for the missing child believed to be the victim of foul play. The mother of Neveah, Miriam Gallegos, 4/25/1987, is being held in the Denver City Jail for investigation of accessory to murder. Investigators determined that the body of the child might have been placed into a large plastic bag, and then disposed of somewhere in the Capitol Hill area. Neveah is described as a Caucasian female, approximately 40 pounds in weight, and 3Õ6Ó in height, with brown hair and eyes. Neveah may have been wearing a red, long sleeved shirt, with a white elephant on the front, and red sweat pants. The Denver Police Department continues the investigation and search for the missing three-year-old. A Denver District Court judge today delayed the trial of Angel Ray Montoya, the 25-year-old man accused of killing his girlfriend’s 3-year-old daughter, Neveah Gallegos, in 2007 before hiding her body in a culvert.

Lawyers spent this week selecting a jury to hear the case and had planned opening arguments for this morning. A health issue with one of the witnesses contributed to the delay.

The parties will meet Feb. 24 to reschedule the trial. Neveah’s mother, Miriam Gallegos, has previously been sentenced to 12 years in prison in January for her part in covering up the death.
