LOVELAND, Colo.—Loveland police have issued a summons to an employee of a medical marijuana dispensary that allegedly stayed open beyond the city’s deadline for pot shops to close.

Residents voted in November to ban dispensaries in city limits, and existing ones had until Tuesday to close. Police say they issued a summons to Colorado Canna Care employee Crystal McDaniel after finding the shop open Tuesday.

The dispensary is among three that filed a pending lawsuit challenging the city’s ban.

A lawyer representing the dispensary declined to comment on the summons. The Loveland Reporter-Herald reports McDaniel could face a $1,000 fine or 90 days in jail.

A voter-approved amendment to the state constitution allows registered patients with certain medical conditions to use limited amounts of marijuana, but cities can ban dispensaries.
