FORT COLLINS — A judge is considering whether prosecutors waited too long to pursue a case against a Fort Collins police detective accused of lying in a murder case.

Attorneys for Lt. James Broderick argued Monday that the three-year statute of limitations has run out on the perjury charges against him and want a judge to throw out the case.

The Greeley Tribune reported that prosecutors say the clock doesn’t start ticking until the alleged acts are discovered.

Broderick is charged with seven counts of perjury stemming from his investigation and testimony in the 1999 murder conviction of Timothy Masters. He has pleaded not guilty.

Masters was convicted of killing Peggy Hettrick of Fort Collins. He was released from prison in 2008 when new DNA testing led to his conviction being overturned. Greeley Tribune
