The overflowing sewer water from a Larimer Square business has landed the tenant in hot water.

Landlord Larimer Square North LLC has filed suit in Denver District Court to evict Lotus Concepts Corp., owner and operator of the nightclub Suite 200, for repeated complaints of water damage from the retailers below the second-floor business.

“There have been a number of catastrophic leaks,” said Joe Vost rejs, chief operating officer for Larimer Square. “After the last one, we notified Suite 200 that we wanted the business to close until a permanent solution to the leaks could be found. They declined to that. As a result, the landlord sought to evict the tenant.”

The next hearing on the matter is scheduled for Aug. 31. Tenants plagued by water damage from alleged overflowing toilets at Suite 200 include Cry Baby Ranch, TAG Raw Bar, gift shop BrittneyLynn, the bluejeans store Denim One and LaFame Boutique. The stores have lost revenue because of closures.

“I don’t know what’s caused the sewer backups, but it’s not uncommon in nightclubs to have significant backups as a result of patrons dropping cellphones into the toilets,” Vostrejs said.

Suite 200 owner Francois Safieddine said, “There are two sides to this story, and we believe that we have done everything possible under our control to address the issues that resulted in this dispute.”

But Vostrejs said the damage from Suite 200’s water leak to other tenants has been done. “In a nightclub with hundreds of people, if they’re not controlled, they will continue to flush the toilets and run the water. The next thing you know, you’ve got flooding.”
