Fort Collins police have filed charges against 29-year-old Daniel Derby of Fort Collins in a fatal head-on collision that happened in July.

Derby faces seven charges, including vehicular homicide, for DUI and for recklessness, vehicular assault, driving under the influence of drugs, and unlawful use of a controlled substance.

The accident occurred on July 11 on Timberline Road, approximately a quarter-mile north of Prospect Road.

A Ford Crown Victoria and a Ford Explorer were traveling north on Timberline Road, when a southbound Honda sedan driven by Derby suddenly crossed over the center line.

The Honda side-swiped the driver’s side mirror of the Crown Victoria and then collided head-on with the Explorer.

The driver of the Crown Victoria was not injured, and the driver of the Explorer was transported to an area hospital with moderate injuries.

Derby and front seat passenger, Jessica Whipple, 23, of Fort Collins, were seriously injured and had to be extricated from the vehicle.

Both were transported to Medical Center of the Rockies where Whipple later died.

Derby is already in custody at Larimer County Detention Center on unrelated charges.
