LOGAN, Utah—A Colorado man is getting a second chance to revoke his guilty plea after he was sentenced to 15 years to life in prison in the 2008 death of a woman whose body was found near Utah’s Logan River.

The Utah Court of Appeals on Thursday ruled 44-year-old Robert Warren Ferretti did not have enough time to argue why he should be able to withdraw his plea.

The Salt Lake Tribune reports ( ) the case now goes back to the lower court.

Ferretti was charged with murder in the shooting death of 33-year-old Tiffany Britt Jarmon.

The Pueblo resident pleaded guilty in January 2010. An obstructing justice charge against him was dropped.

Detectives linked Ferretti to the slaying when they found Jarmon’s blood in an SUV registered to him.
