Rape allegations leveled at a small town cop involve a gathering of three people and over consumption of alcohol, according to court documents.
Log Lane Village town marshall Edwin Irizarry-Urrutia, 33, was arrested Tuesday on suspicion of sexual assault. Log Lane Village is a town of about 900 people northwest of Fort Morgan.
According to an arrest affidavit in the case, the accuser went to Irizarry-Urrutia’s home in Fort Morgan with a female friend on Sept. 15.
Irizarry-Urrutia and the alleged victim had not met before, but the woman’s friend knew the marshall.
Before the meeting at Irizarry-Urrutia’s home, he had sent text messages to the woman he knew, suggesting that the alleged victim join them for a sexual threesome.
Irizarry-Urrutia also sent nude photos of himself, according to the affidavit, but accuser did not look at them.
Before agreeing to go to the residence, the alleged victim saw the text, and responded back to her friend: “Just no threesomes, drunk or not. Haha,” the affidavit said.
At Irizarry-Urrutia’s home, the complainant drank two drinks, the second one in a minute’s time, and two shots. After consuming the alcohol she became extremely intoxicated and felt ill, that affidavit said.
Irizarry-Urrutia and the other woman, whose name is redacted from the court document, tried to feed the intoxicated woman pizza, “but she was too drunk” and only able to eat three or four bites.
The friend and Irizarry-Urrutia carried the alleged victim to a bed where they undressed her.
According to the affidavit, Irizarry-Urrutia had consensual sex with the other woman, in the same bed the complainant was in. He then allegedly had sex with the intoxicated woman, who called police investigators the next day from her home.
According to the affidavit, the complainant told her friend: “I never would have done this if I was sober.”
The complainant’s friend told investigators that the alleged victim was “very out of it” and she “hadn’t seen anyone that drunk since high school.”
The friend also told investigators she feels Irizarry-Urrutia put the two women “in a bad situation.”
