DENVER—A man accused of conspiracy to distribute cocaine is asking a federal judge to dismiss the charges after Denver police destroyed nearly nine pounds of cocaine.

Authorities say the evidence was going to be used as evidence in the upcoming trial of convicted murderer Brian Hicks.

Denver police told KCNC-TV () they got rid of the cocaine by mistake.

Hicks was convicted in the murder of Kalonnian Clark, who was to testify against him in another case. His car was used in the killing of Denver Bronco Darrent Williams, though Hicks was in jail at the time.
